Terms of service

Factum Report ("Factum", "we") is operated by Factum, Inc., a Delaware corporation. These terms govern your use of factumreport.com and every report, file or document issued through it (a "file"). By using the site or requesting a file you accept these terms.

What a file is

A file is a document that reports construction cost figures and bid positions derived from dated public records and from modeled figures that are labeled as such. Every figure in a file carries one of three labels: Public record, Declared on the permit, or Modeled. A file reports position against the record; it is not an estimate of what work should cost, not an opinion of fair price, and not a recommendation to pay, bid, reject, award or lend.

What Factum is not

Factum is not a licensed appraiser, estimator, engineer, architect, surveyor, contractor, broker or adjuster, and a file is not professional advice of any of those kinds. A file does not predict who wins a bid; a low bid is a low bid, not a confirmed award. Decisions made with a file are yours. Where a licensed professional's judgment is required by law or by a lender, a file does not replace it.

The free report and paid files

A free report shows sections 1, 2 and 11 of the file for one address, plan or bid, with every source listed. A paid file is the full eleven-section file at the price printed on /pricing at the time of purchase. Prices are in US dollars and exclude sales tax where it applies. Payment is collected by Stripe; Factum never holds your card number. A code, when you have one, is entered at checkout and applies to one file unless its terms say otherwise. The printed price is the price; no file is sold below the floor published for its kind.

Refunds

A paid file is refunded in full when it cannot be written, when the records for the place do not support a determination, or when the file is not delivered within 24 hours of payment. Once a file has been delivered and opened it is not refundable, because it is a document you now hold. Refund requests go to files@factumreport.com with the report ID.

Your inputs

You confirm that you have the right to submit any plan, drawing, schedule, bid or other document you upload, and that it contains no information you are not permitted to share. Uploads are used only to write the file they were submitted for, as described in Data handling.

Use of a file

You may read, print, store and cite a file, quote it with its report ID, attach it to a loan file, a bid review or a plan check, and share its verification link. You may not resell a file, remove its report ID, hash or labels, present it as your own work or as a professional opinion, or use it to train a model or build a competing dataset. The report ID is the permanent public record that a file was issued; the file's content remains private to the buyer and to anyone holding its link.

Accuracy and the record

Factum reads public records as published and names each one with a URL and an as-of date. Records change; a file is accurate as of its as-of date and is not updated afterwards. Modeled figures carry their method in the note. Factum does not warrant that a record is complete or that an agency has published every award. If you find an error in a file, write to files@factumreport.com with the report ID and the line; corrections are issued as a new file with a new as-of date.

Limitation of liability

To the fullest extent the law allows, Factum's total liability for any claim arising from the site or a file is limited to the amount you paid for that file. Factum is not liable for indirect, consequential or special losses, including lost profits, a lost bid or a lending decision, arising from the use of a file.

Accounts and the service

You are responsible for the email address you use to receive files. Factum may suspend an account that submits documents it has no right to share, attempts to defeat verification, or scrapes the site. Factum may change the site, the fee schedule and these terms; the terms in force are the ones published here on the day you request a file.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and any dispute is brought in the state or federal courts sitting in Delaware, unless the law of your place of residence requires otherwise.
